1 Scope and applicability
1.1This Media Usage Policy ("Policy") governs the use of the Content published on the website testationery.in and every page, feed and file served from it (collectively, the "Platform") by Tirth Enterprise, a proprietary concern having its place of business at Amin Marg, Rajkot – 360001, Gujarat, India ("Tirth Enterprise", "we", "us" or "our").
1.2This Policy is published under the Copyright Act, 1957 and the Information Technology Act, 2000, each as amended from time to time, and constitutes an electronic record generated by a computer system that does not require any physical or digital signature.
1.3This Policy applies to every person who views, downloads or otherwise accesses the Content, whether or not that person holds a trade account with us.
2 Definitions
In this Policy, unless the context requires otherwise:
- "Content" means every photograph, image, video and animation of our products, and every scene, background and graphic published with them, on the Platform, including copies served through its image sitemap, structured data and video files.
- "Permission" means a permission to Use Content granted by us in writing under Clause 5.
- "Use" means to copy, download for reuse, reproduce, store, crop, edit, adapt, add a watermark or text to, publish, upload, frame, communicate to the public, or include in any catalogue, listing, advertisement, social-media post or printed material, in whole or in part.
3 Ownership of the Content
3.1The Content is the property of Tirth Enterprise, or is used by us under licence, and is protected as artistic works and cinematograph films under the Copyright Act, 1957. All rights not expressly granted in a Permission are reserved.
3.2The products shown in the Content, and the brands, trade marks, logos and characters on them, belong to their respective owners. Nothing in this Policy or in any Permission grants any right in them.
4 Use that is not permitted
4.1No person may Use any Content without a Permission.
4.2Clause 4.1 applies equally to registered buyers. Buying goods from us, holding a trade account or reselling our products does not by itself grant any right to Use the Content.
4.3Nothing in this Policy restricts viewing the Content on the Platform, or the indexing, caching and display of the Content by search engines in their search results in the ordinary course.
5 How to ask for permission
5.1A request for Permission may be made on WhatsApp to +91 63531 35986 or by email to contact@testationery.in. The request should state which Content is sought, where it will appear (for example, a website, a marketplace listing, social media or print), and for how long.
5.2Permission is valid only when given by us in writing, by email from the address stated in Clause 5.1 or by WhatsApp from the number stated in that clause. It covers only the Content, the purpose and the period stated in it, and may not be transferred to any other person.
5.3We may grant or refuse a request at our discretion.
6 Unauthorised use
6.1Where Content is Used without a Permission, we may require that it be removed, ask the website, marketplace or other service on which it appears to take it down, and pursue the remedies available to us under the Copyright Act, 1957 and any other law for the time being in force.
6.2If you see our Content used elsewhere, please send the link to the page by WhatsApp or by email at the particulars in Clause 5.1.
7 Amendments
7.1We may amend this Policy from time to time. The amended Policy takes effect upon publication on this page, and the date stated at the head of this page will be revised accordingly. A Permission already granted continues on its own terms.
8 Governing law and jurisdiction
8.1This Policy is governed by, and shall be construed in accordance with, the laws of India.
8.2The courts at Rajkot, Gujarat shall have exclusive jurisdiction in respect of any dispute arising out of or in connection with this Policy.
9 Severability
9.1If any provision of this Policy is held to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
